Filing of an European Patent Application

The Slovak Republic is the member of the European patent agreement since July 1, 2002.

To file the European patent application following documents are required:

· The text of the application.
· The name/s of applicant/s.
· The name/s of inventor/s.
· The Priority Document if a national application was filed.

Perfecting the grant of an European Patent in the Slovak Republic

Within three months from the publication of a grant of an European Patent in the Bulletin of EPO, the Slovak translation of the patent file has to be submitted and the payment for the publication has to be covered. The patent owner has to be represented before the Slovak Office by a qualified representative (registered in the Chamber of patent agents).

Further services in the area of patents provided by our agency:

· Drawing up the proposal for the patent determination, patent annulment.
· Answering to the proposal to the patent determination or patent annulment.
· Compiling of the appeal against the decision of the Office.
· Continued prosecution of the legal status of patents, the maintenance in force of patent inclusive.

Additional protection certificates to medicaments:

The Office grants the additional protection certificate to a medicament or to a medicament composition, to the technique of the medicament acquisition or to the mode of the medicament use, providing that:

· The medicament is protected by a basic patent in the Slovak Republic territory.
· The medicament is a component of a medicine (preparation) registered according to the special legal prescription and it concerns the first registration in the Slovak Republic territory.
· During the previous period an additional protection certificate was not granted to the medicament.

Additional protection certificates to plant protection products:

The Office grants additional protection certificates to plant protection products, to the product that is a component of a plant protection preparation which is under the registration according to special regulations after introduction to the market, providing that:

· The product is protected by the basic patent in the Slovak Republic territory.
· The plant protection product is registered according the special regulations and it concerns the registration in the Slovak Republic territory.
· The additional protection certificate for the plant protection products was not granted to the product during the previous period.

The request for the grant of the certificate has to be filed till 6 months from the date of the decision on validity of the validity statement concerning the medicament or plant protection preparation registration in accordance with special regulations. The validity of the additional certificate is maximally 5 years from the date of certificate efficiency.
